WHY PERSONAL PROPERTY APPRAISALS ARE VERY IMPORTANT
The primary purpose of personal property appraisals is to obtain an independent, objective, unbiased, experienced and knowledgeable value estimation of personal property with as much reasonable supporting documentation as practical, which one cannot usually do regarding his or her own personal property because of obvious conflicts of interest. Substantially underestimating or overestimating the values of items can, in some cases, result in severe penalties, interests, fines, and liabilities (e.g. tax donations, solvency issues). Another important purpose of personal property appraisals is to record possession and exact identity of valuable personal property, using photos, and lists consisting of names, makes, model and serial numbers, appearances, conditions, and estimated values should they later be sold, lent, traded, stolen or misappropriated. Vigilant accounting of valuable personal property items often discourages would-be thieves, helps property recovery / compensation, and is very useful for insurance purposes.

PROFESSIONAL APPRAISAL SERVICES I CAN PROVIDE YOU
I can appraise most personal property (chattel) for businesses (sole proprietorship, partnerships, limited liability companies, corporations, institutions, agencies), and-or personal uses for buying, selling, donating, gifting, sale consignments, bartering, trading, lending, exchanging, auctioning, investing, investments, trusts, wills and inheritances (bequests, legacies), taxes, divorces/ separations/estrangements, personal property divisions, distributions, ongoing/anticipated litigation/auditing, contracts, real estate package deals, solvency issues, insured losses and uninsured losses (e.g. disasters, catastrophies, thefts, burglaries, accidents, floods, fires, lightning, explosions, sabotage, vandalism, terrorist acts), judgments/court awards, bankruptcies, adverse possessions/misappropriations, salvaging, et al using the various methods for estimating value (e.g. fair market value, depreciated value, whole replacement costs, partial replacement costs, component parts costs, replication, repair, modification, restoration, size and weight scaling, quantity discounting, salvage value).       Any appraiser can only estimate the value of items, and that estimate is most applicable for the same item or type of item, amount or quantity, age, condition, time, place, circumstances, scarcity, demand, and reason for the appraisal. The reason for a personal property appraisal often dictates the method used for estimating value (e.g. for personal property donations for tax purposes, the IRS requires the fair market value approach), and resulting estimated values often depend to a substantial extent upon the method used. In some cases, the method selected is largely at the discretion of the person who hires the appraiser, which can give him or her advantages over the other party. Appraisals are not usually restricted to just one value estimation method, and additional methods may be also contracted for. NOTE: To be cost effective, item or grouping of items values should average at least $50.
Just like in real estate, the appraised value of an item is not necessarily what one can sell or buy the item for between a fully knowledgeable buyer and seller at arms length who are under no pressure under normal competitive situations, but is an objective and informed estimate as to what ideally an item is worth (ideally, all items should sell and buy at the same price, but in reality, most sellers want more money for an item of theirs than a buyer would like to pay).

I do not professionally appraise or evaluate the following types of items: (1) Real Estate and real estate fixtures (while I am also a licensed real estate salesperson in New Mexico, I am not licensed or qualified to appraise or evaluate real estate or real estate fixtures). (2) Antiques that are not electronic, electrical or mechanical devices or tools, and antiquities. (3) Jewelry, gemstones and precious metals. (4) Works of art. (5) Vehicles (and anything towed by vehicles), aircraft, water craft, and most related accessories. (6) Heavy or hard-to-examine industrial equipment. (7) Animals and plants. (8) Perishable, delicate or very fragile items. (9) Chemicals, biological products, poisons, toxins, highly inflammable, guns, ammunition, explosive, sharp, or otherwise dangerous to handle items. (10) Any property that is illegal to possess or that requires special handling or special permissions to handle, view or access up close. (11) Any property located in a place that is dangerous or hazardous to get to, that requires climbing a ladder of more than a few steps, that requires lying down, crawling, unbalanced reaching, or special instruments for viewing or accessing, or that requires me to lift or move more than 50 lbs to inspect or too bulky for me to handle by myself. (12) Property that is both so unique and unreplicable that there is nothing else reasonable to compare it to. In all of these cases, you should consider hiring someone qualified to do these kinds of special appraisals. Any opinion I provide relating to the estimated value of a type of property I am not qualified or licensed to appraise, such as those described in this part, is to be viewed strictly as a personal lay person opinion.

I also prefer to minimally handle and operate the personal property itself to minimize my risks of accidentally disturbing, damaging or misaligning something. This is particularly important when it comes to such things as computers, peripherals and electronic equipment where if possible the person(s) most familiar with the cabling, operation and idiosyncrasies of the system should do all handling, functional tests and operations. And when it comes to items whose history of uses, problems, repairs and modifications is important. Also, young children, infirm persons and animals should not be in the vicinity of the appraisal sites during appraisal periods. And the appraisal site and items to be appraised should be as clean and uncluttered as reasonably possible. And it often speeds things up to have the items on or near a clean, cluttered, level and sturdy surface (e.g. table or workbench) with a 120 VAC power source within a few feet away. In addition to being able to more accurately and safely perform the appraisal, with others helping to provide immediate access to, bring out, identify, describe the history of, and demonstrate cosmetic and functional conditions, appraisals are often faster - saving YOU money. The objective is to be as accurate and as complete as reasonably possible under the circumstances. MY CHARGES ARE: I aim to provide you the most accurate and professionally done personal property appraisal I reasonably can, and in the shortest amount of time to minimize your costs so that you will rely upon me for your future appraisal needs. I charge 75 cents per minute ($45/hr) based on every minute that I am at a site engaged in appraising property, discussing the property to be appraised in any way, and recording, researching, analyzing, compiling, copying, transmitting, and reporting the results, and 30 cents per minute ($18/hr) for every minute in which these activities are conducted away from the appraisal site (compare my charges to most other personal property appraisers who charge $50 to $100+ per hour, and the substantial costs you should SAVE by going through me!). I do not charge time at your place spent on unrelated phone calls, meals and bathroom breaks (if bathroom is located within 100 feet of appraisal site). If my testimony is ever needed, my time for preparing and giving testimony of any kind, is separately contracted for (testimony hourly fees are negotiable but are usually $75+/hr, plus all expenses (travel, meals, stays), and depend on the type and extent of testimony required and contracted for). In addition, for travel, I charge $5 per mile for the first 5 miles, $2 per mile for the 6th to 50th mile, and $1 per mile for each additional mile to get to the property's address from my address. And I charge the same rate to return from the property's address to my address, and for going to and from more than one address you have hired me to inspect property at. In addition, for all travel more than 50 miles from my address, I charge a minimum of $75 per night to stay (includes my meals) in a motel for however many days I will need to appraise your property (if appraisal time plus travel time (both ways) require more than 12 hours total or appraisal site is more than 200 miles from Albuquerque). The minimum total charge for any inspection is $50 (plus all relevant travel and stay charges, if any). Your total charge is based on all of these rates as they apply to the inspection of your personal property. All payments must be by cash, Postal money order, certified or cashier's check, or personal property (pre-approved in writing by me). Personal checks, credit cards, credit accounts, and "on approvals" are not permitted at this time. For all invalid payments, the maximum permitted by the law of your jurisdiction for a "bad check" fee applies (up to $100), plus you indemnify me for all reasonable expenses, legal fees and court costs to collect what is owed me. No refunds are permitted. REQUIRED NONREFUNDABLE PREPAYMENT: The $50 minimum total charge plus all estimated travel and staying expenses described above.

REASONS FOR POLICIES : For those who might ask why I have so many policies. The answer is simple: Today's overly-legalistic business environment reality requires them. Period. When you buy just about anything today - product or service - it usually is accompanied by some long, detailed set of official disclaimers and other policies. The greater the variety and complexity of the products and services sold - the more disclaimers. Even contracting for a "simple" fax service these days can require a 9-page contract! Personally, I don't like them any more than you do. And it is certainly not my intent for any of my policies to be viewed as unfriendly or personally insulting in any way to my good clients. AN ESTIMATE OF VALUE FOR ANY ITEM IS NOT MEANT TO BE INTERPRETED AS WHAT SOMEONE MUST, SHOULD OR WILL SELL OR BUY THE ITEM FOR, BUT MERELY AS AN EDUCATED GUIDE TO WHAT I BELIEVE IT SHOULD BE WORTH. ANY ITEMS VALUE MAY CHANGE FROM THE APPRAISED VALUE SHOULD THE CONDITION, QUANTITY, AGE, TIMING, PLACE, SCARCITY, DEMAND, REASONS FOR THE APPRAISAL, OR CIRCUMSTANCES OF THE ITEM SUBSTANTIALLY CHANGE. For example, a new computer you bought last year will be worth substantially less today than when you purchased it.

I NEITHER OFFER NOR PROVIDE ANY MONEY-BACK GUARANTEE FOR ANY SERVICE I PERFORM. For example, any item may appraise for more or less than what you expected or I initially believed it would appraise for.

I ASSUME NO LIABILITY THAT THE CLIENT HAS THE FULL LEGAL RIGHT TO CONTRACT FOR MY SERVICES; IF PARENTAL- OR GUARDIAN-TYPE OR OTHER PERMISSION IS REQUIRED FOR ANY SUCH CONTRACT ACTION, PRIOR EXPLICIT PARENTAL OR LEGAL GUARDIAN PERMISSION IS REQUIRED. IF THE CLIENT PLACED THIS CONTRACT USING FRAUD OR DECEIT, ALL WARRANTIES, IF ANY, ARE NULL AND VOID.

ALL POLICIES FOUND HEREIN ARE APPLIED TO THE FULL EXTENT PERMITTED BY LAW. IF THERE IS ANY DISAGREEMENT AS TO THE INTERPRETATION OF ANY POLICY DESCRIBED HEREIN, ANY REASONABLE INTERPRETATION BY ME SHALL PREVAIL. IF ANY POLICY PROVISION IS FOUND TO BE UNENFORCEABLE, ALL OTHER TERMS AND CONDITIONS SHALL REMAIN FULLY IN EFFECT. LEGAL JURISDICTION IN ALL MATTERS RESIDES SOLELY AND EXCLUSIVELY IN ALBUQUERQUE, NEW MEXICO. THIS AGREEMENT SHALL BE GOVERNED EXCLUSIVELY BY NEW MEXICO LAW, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW PROVISION OR RULE (REGARDLESS OF JURISDICTION) THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN ALBUQUERQUE, NM. ALL UNRESOLVED DISPUTES AND CLAIMS MUST BE SUBMITTED TO BINDING ARBITRATION IN ALBUQUERQUE, NM, ARBITRATED IN THE ENGLISH LANGUAGE, AND LIMITED TO THE SCOPE OF THESE POLICIES. EACH PARTY IS RESPONSIBLE FOR ALL OF ITS OWN COSTS RELATED DIRECTLY OR INDIRECTLY TO ANY ARBITRATION PROCESS. ANY DISPUTE OR CLAIM MUST BE INITIATED WITHIN SIX MONTHS AFTER THE DISPUTE OR CLAIM ARISES. TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, REGARDLESS IF THE PERSON IS A CLIENT OR NOT, SERVICE SHALL BE ACTUAL, PERSONAL AND EXPRESSED, AND IN WRITING (BUT NOT BY EMAIL, AND NOT BY PUBLICATION), WITH PROOF OF SERVICE, INCLUDE CLEAR, SPECIFIC, COMPLETE AND DETAILED DESCRIPTIONS OF ALL PARTIES, ATTORNEYS, DISPUTES AND ACTIONS, AND SERVED AT LEAST 60 DAYS PRIOR TO FIRST ACTION. THE CLIENT WAIVES AND FORGOES ALL OTHER FORMS OF LEGAL REMEDY.

IF I OR ANY OF MY EMPLOYEES, AGENTS, LICENSORS, LEASORS, SUPPLIERS, DISTRIBUTORS OR SUBCONTRACTORS (SHOULD I HAVE ANY) OR FAMILY MEMBERS BECOME A PART OF ANY LEGAL, REGULATORY OR ADMINISTRATIVE ACTION BECAUSE OF THE CLIENT'S BUSINESS OR RELATIONSHIP WITH ANY OF THEM, OR IF THE CLIENT HAS MADE ANY FALSE, DECEPTIVE OR MISLEADING STATEMENT, THE CLIENT SHALL PERSONALLY, TOTALLY AND IMMEDIATELY INDEMNIFY, DEFEND, AND HOLD FREE AND HARMLESS ME AND ALL OF MY OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, LEASORS, SUPPLIERS, DISTRIBUTORS, SUBCONTRACTORS AND FAMILY MEMBERS FROM ALL LAWSUITS, JUDGMENTS, DECREES, COSTS, EXPENSES AND LOSSES, IF ANY, WHICH DIRECTLY OR INDIRECTLY RESULT. FURTHERMORE, THE CLIENT SHALL PERSONALLY, TOTALLY AND IMMEDIATELY INDEMNIFY, DEFEND, AND HOLD ME AND ALL OF MY OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, LEASORS, SUPPLIERS, DISTRIBUTORS, SUBCONTRACTORS, AND FAMILY MEMBERS FREE AND HARMLESS FROM ALL CLAIMS, DAMAGES, OR LAWSUITS OF ANY KIND, IF ANY, INCLUDING ALL REASONABLE ATTORNEY AND OTHER FEES AND LEGAL COSTS ARISING IN ANY PART OUT OF THE CLIENT'S NEGLIGENT, DISHONEST, TORTIOUS, BREACH-OF-CONTRACT AND-OR ILLEGAL ACTS OR IN ANY WAY CAUSED BY THE CLIENT OR ANY OF THE CLIENT'S EMPLOYEES OR AGENTS. THIS INCLUDES, BUT IS NOT LIMITED TO, ALL CLAIMS, DISPUTES, DAMAGES, REGULATORY ACTIONS, AND-OR LAWSUITS ARISING OUT OF ANY USE, MISUSE OR ABUSE BY THE CLIENT OF ANY OF MY SERVICES, OR CAUSED BY THE VIOLATION OF ANY LAWFUL STATUTE OR REGULATION.

CONTACT POLICIES

Because I may receive 100s of letters, phone calls and emails per week, common sense and simple time-savers (e.g. an SASE, well thought out inquiry, clear and concise description) often make my job to provide you my best response much easier. Do NOT make any unsolicited promotionary phone calls or emails to me! Instead, send me your offer by mail. Include your SASE. Because of 9/11-related concerns, I have had to tighten our security.

If you approach me as any kind of author, researcher, reporter, producer, investigator, legal entity, competitor, or in any similar capacity, you MUST first, unless otherwise forbidden by law, clearly and accurately identify yourself and all intentions, obtain explicit written permission from me, and fully disclose all intention to:

All contacts made with me must be strictly within the scope of legal purposes only. All illegal contacts are strictly forbidden.

FACILITY VISITS: Because of the high level of security my work can require, I NEVER PERMIT VISITS TO MY FACILITIES OR MEET WITH A CLIENT WITHOUT A PRIOR APPOINTMENT AND GOOD REASON.

EMAILS & FAXES: Because I am out in the field a lot, faxes are permitted only on an pre-approved basis and I cannot guarantee immediate responses to faxes. For a compelling need, I may make an exception and authorize Faxing of other items; in which cases, please call/write me and describe what you would like to Fax me. NOTE: I charge $100 per page for every page of unsolicited advertising I am faxed or emailed. Please Fax me as few pages as possible (preferably no cover sheet). Please clearly sign and date all your Faxes. You may send me faxes as image file or text attachments to emails to me (i.e. virtual faxes), but they must be sent only as .tif, .jpg, .gif, .bmp, or .pdf (with printing allowed) files. NEVER SEND ME AN EMAIL ATTACHMENT FOR A .DOC, .EXE, .ZIP or ANY OTHER EXECUTABLE OR COMPRESSED FILE FORMAT - THESE WILL ALWAYS BE IMMEDIATELY DELETED, AND WITHOUT NOTIFICATION TO THE SENDER, AND I ASSUME NO RESPONSIBILITY FOR THEM. And all attached files from unknown subjects, unexpected, and-or suspicious will also be handled in the same manner.

Generally, since I am often in the field and cannot respond to mail on a quick basis, I welcome and encourage email contacts as usually the fastest means of getting a response from me. And you can use emails to notify me when you sent contract, request, inquiry or payment (and the type and amount of your payment). However, there are several email restrictions:
       (1) Please never send me personal information via ordinary email. For your own security, since ordinary email is really not private, use regular First Class Mail (preferred), fax or phone call to inform me of personal information, if any, which is part of your appraisal.
       (2) Please never send me spam, or junk or commercial mail, email or faxes. My email is reserved strictly for my clients and potential clients to inquire about my personal property appraisal services, place orders, and for technical and client support of my offers and client orders, and notifications of payments and contracts.
        (3) Please never send me an email attachment in executable or compressed file format, or computer virus, trojan horse or worm. I never open email attachments with a executable or compressed file format - I always discard them - and I am never responsible for them. The sender is fully responsible for anything he/she sends me which damages my system or files, or in any way compromises the privacy and confidentiality or retrieves any of our files, passwords or keywords.

LETTERS, and PACKAGES (include all envelopes over 1 lb): Please clearly sign and date all written material you send me.
    General: When you write to me for any reason other than to place an order or inquire about one, please observe the following:
      For best responses, be sure to include a #10 SASE. I always carefully inspect all received packages. I am not responsible for the disposition of unauthorized, poorly labeled, tampered with or otherwise suspicious packages I receive (usually, I will attempt to contact sender first). Please use this procedure:
             First, clear your package with me in writing my email, mail or fax (not by phone) prior to shipping it to me. Before you ship a package to me, your package must first be assigned a package # by me, and that # must clearly appear in clearly readable lettering on the front of your package. I assume no liability for any package sent to me without the correct package # properly placed on your package.
             Clearly label your package with your verifiable name and return street address, and actual phone number or email address.
             Do not ship to me anything that is illegal or hazardous to ship, store, and-or possess.
             Do not ship to me any opaque unopened containers.
      For packages that I accept, if the sender does not provide me a reasonable written explanation, within 30 days of me receiving the package, describing why it was sent or returned to me, I will dispose of its contents as I see fit at no liability to me, unless other written arrangements have been made. To reship an undeliverable, refused or return-for-refund package, I charge the normal S/H plus a MINIMUM 25% fee that must be prepaid by sender.

    Certified, Registered, Insured & Proof-of-Delivery (CRIP) Mail: Because of past CRIP abuse, even if inadvertently signed for, I take no responsibility for CRIP mail that does not meet all of these standards and reserve the right to trash unopened with no harm or liability to myself (I will waive (4) and (5) requirement if the CRIP arrival is preceded by a signed and dated fax or non-CRIP postal letter by the sender that notifies me of his/her upcoming CRIP mail, includes a copy of the CRIP envelope or package face, and includes all of the information required by (4) and (5)), that:
       (1) The CRIP envelope/package must NOT be a "RESTRICTED DELIVERY" one.
       (2) The CRIP envelope/package must be addressed to: "JOHN J. WILLIAMS, APPRAISER, P.O. Box 23097, Albuquerque, NM 87192." No other CRIPs will be accepted by me, except those of a clearly identifiable government origin.
       (3) The CRIP envelope/package must have a clear, truthful, accurate and verifiable return name and address, which all must 100% match with that on the return card, if any. Its CRIP number must also match that on the return card.
       (4) Below the return address, the word, "From: " must be printed, followed by the clear, complete and actual name and address of the sending person (and also organization, if it also relates to an organization) which the contents most relates to.
        (5) Below the "From: " line, the word, "Content: " must appear, followed by a clear, 100% truthful and complete description disclosing ALL of the actual contents (e.g. "contract", "inquiry", "legal document", etc.). If a legal document, you must also fully disclose under "Content" exactly what type of legal document, and if a case is involved, the specific case number and court. If you include any attachments, unrelated materials, or supplementary materials, these too must also all be fully disclosed under "Content".

DOCUMENT RETENTION & DESTRUCTION POLICIES: Like most businesses, I am inundated with paperwork! This creates serious storage and security problems. Therefore, to reduce my paperwork load and to best protect my clients, as my policy, I now destroy all: (1) CONTRACTS: After 6 months retention from last day of believed contract execution, (2) COMPLAINTS: After 6 months retention from date of complaint, (3) ANY OTHER CUSTOMER-CREATED DOCUMENT: After 6 months retention from day of our receipt of document. (4) ANY OTHER DOCUMENT I CREATE ABOUT A CLIENT: (e.g. Invoice, Report): After 6 months retention from day of its creation.
        WHAT IS MEANT BY "DESTRUCTION": "Destruction" generally refers to thoroughly shredding or burning up the documents. I NEVER voluntarily provide a document that refer to a specific customer to any corporate or government entity without first obtaining the explicit written permission of the person.
        EXCEPTIONS: I will retain documents longer than the 6-month retention period if no more than 30 days elapses between communications I received and/or made between me and the client about a document that refers to the client, that a legal or regulatory action was filed before the retention period elapses that is reasonably likely to require the document, that the document is legally required by known tax or business law or is vital for the existence or operation of my appraisal services, that the document relates to a fraud attempted or committed against me, that I otherwise believe I should retain the document to legally protect me, or that the customer has explicitly in writing asked me to preserve for him/her the document for longer than the retention period (in which case, storage fees may apply). If an exception did apply, once I reasonably believe that it no longer applies, I may then immediately destroy the document. I accept no liability, loss or disadvantage for the destruction or retention of any document based on these published policies. These policies go into full effect on 5/7/03.

I am interested in buying, selling and trading electronic parts, hardware & test equipment, modern computer systems, peripherals & software, printing & publishing equipment, parts & supplies, books, small parts, et al - too numerous to list!

I am especially interested in large quantities of small electronic parts, such as ICs and transistors (I am NOT interested in most used/large/heavy/bulky parts, no dirty/defective parts, no radios/TVs/VCRs/illegal or similar items [with the exception that I am interested in vintage radios in good condition]).
